Privacy Policy and Terms of Use

Exquisite Art App (“the App”) is a collaborative drawing application developed by Catspaw Systems LLC (“we”, “us”, or “our”).
This document describes how we collect, use, store, and share information, as well as the terms governing your use of the App.
By using the App, you agree to the Terms of Use described below. By submitting artwork, you agree to the provisions governing user-generated content, including the license permitting its use in promotional materials.
Part I — Privacy Policy
1. Information We Collect
a. Personal Information
We do not require users to create an account or provide personally identifiable information to use the App.
We do not intentionally collect names, email addresses, or other personal identifiers unless you voluntarily provide them, such as when contacting us for support.
Certain information may be processed by Apple or our advertising partners in accordance with their respective privacy policies.
b. Artwork and User-Generated Content
When you create or contribute to drawings, your artwork is uploaded to Apple’s CloudKit infrastructure to enable collaboration with other users.
Artwork may be combined with contributions from other users and displayed in the App’s public gallery.
By submitting artwork, you understand that it may be viewed by other users of the App.
We may remove artwork that violates our content guidelines or is reported as inappropriate.
c. Diagnostic and Usage Information
We may receive diagnostic and usage information, including:

Apple provides certain diagnostic and analytics information to developers when users have enabled the relevant data-sharing settings on their devices.
d. Location Data
We do not request access to your device’s precise location or collect personally identifiable location information.
We may receive aggregated geographic information through Apple’s App Analytics services, such as the countries or regions where the App is used.
Advertising partners may independently process location-related information in accordance with their privacy policies and applicable permissions.
e. Advertising Data
The App may display advertisements provided by Google.
Our advertising partners may collect device identifiers, advertising identifiers, and other information necessary to deliver, measure, and improve advertisements, subject to applicable privacy settings and permissions.
Where required, we request permission through Apple’s App Tracking Transparency framework before allowing tracking across apps and websites.
2. How We Use Information
We use information collected through the App to:
Enable collaborative drawing and artwork sharing.Store and display completed artwork in the public gallery.Maintain and improve App functionality.Identify and resolve technical issues.Prevent misuse and remove inappropriate content.Display advertisements and support optional purchases.Analyze aggregated usage and performance trends.
3. Third-Party Services
The App uses services provided by third parties, including:
Apple CloudKit: Stores and synchronizes artwork and other information necessary for collaborative drawing.
Apple App Analytics: Provides aggregated usage information, crash reports, and diagnostics when users have enabled the relevant sharing settings.
Google Advertising: Provides advertisements and may collect information as described in Google’s privacy policies.
Apple App Store: Processes in-app purchases. We do not receive or store your payment card information.
These services operate under their own privacy policies.
4. Public Artwork and Content Moderation
Exquisite is designed around anonymous artistic collaboration.
Artwork submitted to the App may become publicly visible to other users, including contributions incorporated into collaborative drawings.
Users should not include personal information or other sensitive content in their drawings.
We provide mechanisms for reporting inappropriate artwork and reserve the right to remove content that violates our guidelines.
Artwork may also be used in promotional materials as described in the Terms of Use below.
5. Data Retention and Deletion
Artwork may be retained in Apple’s CloudKit infrastructure for as long as necessary to provide the collaborative drawing experience and maintain the public gallery.
We may delete artwork that is reported, violates our guidelines, or is no longer required for App functionality.
Because artwork is submitted anonymously and may be incorporated into collaborative compositions, we may not always be able to identify or remove an individual user’s contribution.
Users may contact us to request removal of specific artwork.
Diagnostic and analytics information is retained according to the applicable service providers’ retention policies.
6. Data Sharing
We do not directly sell personal information to data brokers.
Artwork submitted to the App is shared with other users as part of the collaborative drawing experience.
Information may also be processed by third-party service providers for purposes including:

Our advertising partners may process certain information to provide and measure advertisements, subject to applicable privacy laws and user choices. Depending on the advertising services used, some processing may qualify as sharing or selling personal information under applicable privacy laws.
We do not independently provide personal information to unrelated third parties for their direct marketing purposes.
7. Your Privacy Rights
Depending on your location, you may have rights to:
Access, correct, or request deletion of personal information.Withdraw consent where applicable.Object to or restrict certain processing activities.Opt out of certain advertising-related data sharing.
You can manage certain privacy preferences through your device’s iOS settings, including advertising tracking permissions and analytics sharing.

8. Children’s Privacy
The App is not designed to collect personal information from children.
We do not knowingly collect personally identifiable information from children. If we become aware that such information has been collected without any required parental consent or other lawful basis, we will take reasonable steps to delete it.
9. Security
We take reasonable measures to protect information from unauthorized access, alteration, or disclosure.
Artwork and associated application data are stored using Apple’s CloudKit infrastructure.
However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Changes to This Privacy Policy
We may update this Privacy Policy periodically to reflect changes in the App, applicable laws, or our data practices.
Updates will be published with a revised effective date. We encourage users to review this policy periodically.
11. Promotional Use of Artwork
Artwork submitted to the App, including completed collaborative compositions, may be selected for use in promotional materials for Exquisite.
This includes App Store screenshots, advertisements, social media posts, promotional videos, and our websites.
Such use is governed by the license granted in the Terms of Use below.
We do not claim ownership of artwork created by our users.

Part II — Terms of Use
1. Acceptance of Terms
By accessing or using Exquisite Art App, you agree to these Terms of Use.
By submitting artwork to the App, you agree to the provisions governing user-generated content, including the license permitting its display, modification, distribution, and promotional use.
If you do not agree to these terms, you should not submit artwork or use the App.
2. User-Generated Content and Ownership
You retain ownership of any original artwork you create and submit through the App.
Exquisite is a collaborative drawing experience in which artwork may be combined with contributions from other users to create completed compositions.
You acknowledge that your contributions may be incorporated into collaborative artwork and displayed publicly within the App.
You represent that you have the necessary rights to submit your artwork and grant the permissions described in these Terms of Use.
You must not submit artwork that infringes the intellectual property rights of others.
3. License to Use Submitted Artwork
By submitting artwork, you grant Catspaw Systems LLC a worldwide, non-exclusive, royalty-free license to store, reproduce, display, distribute, modify, adapt, and combine your artwork with contributions from other users for the purposes of operating, maintaining, improving, and promoting the App.
This license includes the right to feature submitted artwork, including completed collaborative drawings, in:
App Store screenshots and previewsPromotional videosWebsites associated with the AppSocial media postsDigital and print advertisementsOther marketing materials promoting the App
Artwork may be used for promotional purposes without identifying or crediting individual contributors, to the extent permitted by applicable law.
This license does not transfer ownership of your artwork to Catspaw Systems LLC.
We will not sell individual user-submitted artwork as standalone merchandise or license it to unrelated third parties for their independent commercial use without additional permission.
4. Collaborative Artwork
You acknowledge that artwork submitted through the App may become part of a collaborative composition created by multiple users.
Each contributor retains ownership of their original contribution, subject to the license granted under these Terms of Use.
Completed collaborative compositions may be displayed in the App’s public gallery and used to promote the App.
Because collaborative compositions incorporate contributions from multiple users, individual contributions may not always be separable from completed artwork.
5. Acceptable Content
Users must not submit artwork containing:
Unlawful contentThreatening, harassing, or hateful materialSexually exploitative or otherwise inappropriate contentContent that infringes the intellectual property rights of othersPersonal information belonging to another person without their permissionMaterial intended to abuse, disrupt, or interfere with the App or its users
We reserve the right to remove content that violates these guidelines or is otherwise inappropriate for the App.
We may also restrict access to the App when necessary to protect users, maintain the service, or comply with applicable laws.
Users may report inappropriate artwork using the reporting features provided in the App.
6. Removal of Artwork and Promotional Materials
Users may contact us to request removal of specific artwork from the App.
We will review removal requests and take reasonable action where appropriate or legally required.
Because artwork may be incorporated into collaborative compositions, removing an individual contribution may not always be technically feasible without removing the completed composition.
If artwork is removed from the App, we will make reasonable efforts to discontinue its use in new promotional materials upon request.
However, previously published or distributed promotional materials may remain in circulation, subject to applicable legal requirements.
Removal of artwork from the App does not automatically revoke permissions for promotional uses already made under these Terms of Use.
7. Advertising and In-App Purchases
The App may offer advertisements, optional in-app purchases, or other features that support its operation.
In-app purchases are processed through Apple’s App Store and are subject to Apple’s applicable purchase and payment terms.
Prices and available purchase options are displayed within the App before purchase.
Advertising services may be provided by third parties and are subject to the privacy practices described in our Privacy Policy.
8. Availability and Changes to the App
We may modify, suspend, or discontinue features of the App from time to time.
We do not guarantee that the App, its collaborative drawing features, or its public gallery will always be available without interruption.
We may remove artwork or other content when necessary for technical, operational, legal, or moderation reasons.
9. Disclaimer of Warranties
The App is provided on an “as is” and “as available” basis, to the extent permitted by applicable law.
We make no guarantees regarding uninterrupted availability, error-free operation, or permanent preservation of submitted artwork.
Users are encouraged to retain personal copies of artwork they wish to preserve.
Nothing in these Terms of Use excludes warranties or consumer rights that cannot legally be excluded.
10. Limitation of Liability
To the extent permitted by applicable law, Catspaw Systems LLC shall not be liable for indirect, incidental, consequential, or special damages arising from the use of the App, including loss of artwork, interruption of service, or inability to access collaborative content.
Nothing in these Terms of Use limits liability that cannot legally be limited under applicable law.
11. Changes to These Terms
We may update these Terms of Use periodically to reflect changes in the App, its features, or applicable legal requirements.
Updated terms will be published with a revised effective date.
Where required by law, we will provide additional notice or obtain consent before applying material changes.
